Nelson Carey was found guilty of robbery on Friday, October 2nd , by Judge Marie-Chantal Doucet at the Valleyfield courthouse. The event took place on July 8th , 2019 in a store located on Mgr-Langlois blvd in Salaberry-de-Valleyfield.
It was after two and a half days of trial that the judge found Nelson Carey guilty. In all, the magistrate heard 10 prosecution witnesses. With all the evidence filed, Judge Doucet came to the conclusion that Nelson Carey was indeed the perpetrator of the robbery.
Following the decision, the attorney for the Director of Criminal and Penal Prosecutions, Me Mylène Brown, asked the court that Nelson Carey be subject to an assessment to determine whether he could be declared a long-term offender or a dangerous offender.
It is important to emphasize the difference between the two decisions. Dangerous offenders are not mentally ill. Nor are they ordinary criminals, or even repeat offenders, to whom the ordinary Criminal Code provisions relating to sentencing apply. They belong to that small minority of delinquents whom ordinary sentences cannot dissuade or reform and who pose a serious danger to the mental and physical well-being of other members of society. The indefinite sentence allows them to be supervised until their dangerousness subsides.
With respect to long-term offenders, the issue is that the offender will be under strict supervision, even if he has served a sentence in a federal institution. The follow-up can take place over a period of 10 years. To be classified as a long-term offender, the individual must have a prognosis of rehabilitation without recidivism if under supervision.
Criminal path
Nelson Carey has a long history. The 45-year-old has already served 30 years in prison. He has previously been convicted of theft, robbery, conspiracy to murder, hostage-taking and conspiracy. His first conviction dates back to 1995. Note that in 1997, Nelson Carey served two prison terms simultaneously.
